TERMS AND CONDITIONS

1 GENERAL
PEACE BANNERS.ORG is a social sharing network open to all internet users (hereafter referred to as the “User” or “Users”). Every User expressly accepts the Terms and Conditions (“TAC”) as stated hereafter.
The TAC defines the terms and conditions of use of the services as offered by PEACE BANNERS (“PEACE BANNERS”) on the website PEACE BANNERS.ORG (rights, obligations, restrictions and responsibilities related to the deliberate, accidental, regular or intermittent access to PEACE BANNERS.ORG).
The TAC rules in particular the relationship between PEACE BANNERS and the Users of PEACE BANNERS.ORG. When becoming a User or by using PEACE BANNERS.ORG, the Users agree to the TAC.
Regarding PEACE BANNERS.ORG operating mode, the Users may refer to the specific section “PEACE BANNERS.ORG tutorial and guidelines”).
The TAC is susceptible to updates at all times. The Users shall take regular notice of the updates.

2 DEFINITION OF THE SERVICES PROPOSED BY PEACE BANNERS
PEACE BANNERS.ORG is a social network that offers electronic content to its Users as well as to Persons and / or Companies and / or Foundation and / or Organizations (Organizations – non-profit, nongovernmental or otherwise involved in charity, research, public service, or humanitarian action, hereafter referred to as the “Foundation and / or Organization” or “Foundation and / or Organizations”) that wish to be part of PEACE BANNERS.ORG.
The Users can opt for free or paid membership (see “General Terms of Payment”).

3 CONFIDENTIALITY AND DATA USE POLICY
3.1 COMPILATION OF DATA
For all practical purposes relating to the type of platform that it operates and services that it provides, as well as to the good processing and constant improvement of PEACE BANNERS.ORG, PEACE BANNERS collects data (including personal data) which is comprised of information, contents (photos, videos, writings, etc.) and other similar elements (hereafter referred to as «Data»).

3.2 DATA PRIVACY POLICY
Any and every compilation and use of Data on PEACE BANNERS.ORG is subject to PEACE BANNERS’s Data Privacy Policy («DPP»).

3.3 COMPILATION, PROCESSING AND SHARING OF DATA
The present section contains the DPP and describes the conditions in which PEACE BANNERS collects, processes and shares the Data.
PEACE BANNERS compiles the Data as collected through PEACE BANNERS.ORG. By agreeing to the TAC and/or by interacting with PEACE BANNERS.ORG, each User grants PEACE BANNERS permission to collect, transfer, handle, conserve, disclose and otherwise process her/his Data in compliance with the DPP as hereafter stated.

3.4 COLLECTION AND PROCESSING OF DATA UPON SUBSCRIPTION
When subscribing to PEACE BANNERS.ORG, the User provides PEACE BANNERS with Data such as her/his surname, name, date of birth, country of residence and e-mail address.
This Data, along with any additional information such as the date of subscription to PEACE BANNERS.ORG or a profile picture, is made public and may be seen by other Users, as well as third parties.

3.5 DATA POSTED ON PEACE BANNERS.ORG BY THE USERS
Data such as:
– A User’s accounts on other websites,
– The names of Persons and / or Companies, Foundation and / or Organizations and other Users followed by the User.

Further Data is available to the circle of addressees as defined by the User (see article 3.6.7).
The User is responsible for all Data that she/he publishes on PEACE BANNERS.ORG and, by posting this Data on PEACE BANNERS.ORG, the User grants PEACE BANNERS a free and worldwide non-exclusive, transferable, sub-licensable, license for the use of this Data.

This license terminates when the User deletes her/his Data or her/his account according to the TAC.
Caution! When a User uses an application whose operating mode and terms and conditions are particular and unrelated to PEACE BANNERS (such as any other website linking to a social network), this application is likely to request the User’s authorization to access her/his Data as well as the Data that other Users have shared with her/him. Even though PEACE BANNERS requires these applications to respect the confidentiality of the Data, it is the consent given directly by the User to the application that determines to what extent the application is free to keep process and transfer this Data. PEACE BANNERS cautions its Users and advises them to always read carefully the terms and conditions of the applications they use.
When a User posts a video content on her/his Webpage, this video is automatically processed by an outside technical device (such as 23 Video, YouTube, DailyMotion, or any other such device adopted by PEACE BANNERS.ORG at one point or another of its development) that has been adopted by PEACE BANNERS.ORG to post videos. Even though the given device’s logo never shows on PEACE BANNERS.ORG, the User is aware that her/his video content is being processed by that device. It is the User’s responsibility to inquire about the data privacy policy of this video-sharing and broadcast website before putting her/his video content online. PEACE BANNERS shall by no means be held liable for the use by those devices of the content without the User’s consent. The User can choose to address her/his video content to a restricted circle of PEACE BANNERS.ORG Users for a private disclosure, or to all PEACE BANNERS.ORG Users for a public disclosure. The User acknowledges that, in any way, the content is managed and processed by those devices and not by PEACE BANNERS, which again cannot be held liable for the use of the content by those devices without the User’s consent.
When a User posts Data using the setting «All Users», or using the setting which specifies a particular group she/he decides to share this Data with, this implies that she/he, in the first case, allows everyone, including non PEACE BANNERS.ORG users and, in the second case, allows only those who are part of that particular group, to access this Data and to use it, but also to associate it with her/his personal Data. Each User shall take this into account by every posting. Each User acknowledges that those whom she/he is sharing Data with are likely to re-use it and, furthermore, post it on other websites. The User therefore chooses carefully the circle of addressees whom she/he decides to share Data with.
Users are free and welcome to submit comments and suggestions to PEACE BANNERS. Each User understands and accepts however that PEACE BANNERS may use these comments and suggestions liability free, in particular with regards to any financial compensation.

Notwithstanding any conflicting clause in the DPP, PEACE BANNERS is entitled to keep or disclose Data if deemed reasonably necessary to:
– Comply with a law, regulation or request from public authorities;
– Ensure the security of a person, react to fraud or breach of security, or comply with technical requirements;
– Protect PEACE BANNERS’s rights (in particular property rights) and PEACE BANNERS’s legitimate interests.

3.6 DATA POSTED ON PEACE BANNERS.ORG BY THE PERSONS AND / OR COMPANIES AND FOUNDATION AND / OR ORGANIZATIONS
It is the nature of PEACE BANNERS.ORG to serve as a communication and Data transmission platform between the Persons and / or Companies and/or the Foundation and / or Organizations on the one hand, and the Users, on the other hand, by offering space («Webpages») designed to post original, exclusive or non-exclusive Data (including photos, videos, songs, writings, declarations, short stories, etc.).
Each User shall bear in mind that any Data posted on PEACE BANNERS.ORG by a Person and / or Company and/or Foundation and / or Organization is protected by the Person’s and / or Company’s and/or Foundation and / or Organization’s as well as PEACE BANNERS’s intellectual property rights.

When a Persons and / or Companies and/or Foundation and / or Organization post(s) Data on PEACE BANNERS.ORG, the Persons and / or Companies and/or Foundation and / or Organization grant(s) PEACE BANNERS, and therefore PEACE BANNERS’S Users, a free and worldwide non-exclusive, transferable, sub-licensable, license for the use of the Data within the framework and features and settings established by PEACE BANNERS in order to facilitate Data sharing between its Users.
However, as is the case with the Users’ Data posted on PEACE BANNERS.ORG, the Persons and / or Companies and/or Foundation and / or Organization remain(s) the sole owner(s) of their posted Data and may delete it at all time.
During the time when the Data of a Persons and / or Companies and/or Foundation and / or Organization remains posted on PEACE BANNERS.ORG, this Data may be freely shared on PEACE BANNERS.ORG by all the Users who have access to PEACE BANNERS.ORG, whilst remaining the property of the Person and / or Company and/or the Foundation and / or Organization on the one hand, and of PEACE BANNERS on the other hand.

If and when this Data is shared on other websites than PEACE BANNERS.ORG, it remains the exclusive property of the Persons and / or Companies and/or Foundation and / or Organizations concerned on the one hand and of PEACE BANNERS on the other hand and cannot therefore be posted on other websites without the mention of origin «PEACE BANNERS», along with PEACE BANNERS’s logo. Whenever possible, a special feature of PEACE BANNERS.ORG shall prevent the transposition of any Data without the mention of origin. This restriction is a necessary and non-negotiable condition for the use of PEACE BANNERS.ORG and any User who breaches this rule exposes her/himself to an immediate deletion of her/his account, without further notice. Each User undertakes to respect this rule and not to take any technical or other measures aiming at depriving the Data of the mention of origin.

Each User undertakes to share the Data as posted by the Person and / or Company and/or Foundation and / or Organization without modifying it in any way. The User is not allowed to extract the Data from its original context nor is she or he to distort its meaning and purpose. The User undertakes to use the Data as a whole, without paraphrasing, copying, truncating or merging it with any other content and without using it in a way that could harm the image or reputation of the Person and / or Company and/or Foundation and / or Organization concerned. Any User who breaches this rule exposes herself/himself to the immediate deletion of her/his account without further notice.

3.7 COOKIES
Like many other websites, PEACE BANNERS.ORG uses the cookies technology to collect Data and to improve its services.
A cookie is a small data file that is transferred to the hard disk of the User’s computer. PEACE BANNERS may use both session cookies and persistent cookies to better understand how Users interact with PEACE BANNERS.ORG, monitor aggregate usage by the Users and web traffic routing on PEACE BANNERS.ORG, and customize and improve PEACE BANNERS.ORG.

3.8 ADVERTIZING AND OTHER COMMERCIAL CONTENTS POSTED BY PEACE BANNERS
Development, maintenance, research and the implementation of new ideas and of ever-better quality services, as well as the need for PEACE BANNERS to achieve its technological and charity goals imply constant and significant investments and financing.

An important part of the financing comes from advertizing on PEACE BANNERS.ORG.
PEACE BANNERS is aware that this policy may not please all PEACE BANNERS.ORG Users. At the same time, PEACE BANNERS is convinced that PEACE BANNERS.ORG Users will understand that quality services depend on PEACE BANNERS’s ability to finance them.
In consideration of all the previous elements, PEACE BANNERS has established as a goal to dedicate some of its space to display advertizing in a way that is beneficial for Users as well as for advertisers. Users therefore accept the following conditions:
Each User may change her/his confidentiality settings as to limit the way her/his Data is associated with commercial, sponsored or other content (such as a brand she/he likes).
Each User grants PEACE BANNERS the permission to use her/his Data, according to the TAC and to the limits established by the User.
PEACE BANNERS does not communicate Data to advertisers without the User’s express consent, which is given by accepting the present TAC.
The User understands and accepts that PEACE BANNERS cannot always identify commercial content as such.

3.9 TRANSFER OF ACTIVITY
In the case that PEACE BANNERS should go bankrupt or should be implied in a merger, acquisition, reorganization or a sale of its assets, Users’ Data may be sold or transferred in the framework of such an operation.
The obligations set out in the DPP will apply to the Users’ transferred Data.

3.10 PERSONAL DATA MODIFICATION
The User can modify her/his personal data by changing her/his account settings. The User whose personal data is incorrect may require PEACE BANNERS to rectify it.

3.11 DATA PRIVACY POLICY UPDATES
The DPP may be updated at all times by PEACE BANNERS. The most recent version of the DPP rules the way PEACE BANNERS uses and processes the Data. On-going access or use of PEACE BANNERS.ORG after an update of the DPP implies acceptance by the User of the updated DPP.

4 SUBSCRIPTION, ACCOUNT AND DATA SECURITY AND CANCELLATION
The User shall provide her/his real and full name and truthful and complete Data concerning her/him. The User ensures that her/his Data remains truthful and complete. The User undertakes to communicate all Data required by PEACE BANNERS when creating her/his account or subsequently.
The User undertakes not to provide inaccurate Data and not to create an account for another person without that person’s express authorization.
Each User is only entitled to create one personal account.
In the event that PEACE BANNERS deletes her/his account, the User is not entitled to create another account without PEACE BANNERS’s prior authorization.
The User undertakes not to use her/his personal Webpage for commercial purposes without PEACE BANNERS’s prior authorization.
The User may use PEACE BANNERS.ORG only if she/he is at least 13 years old.
The User in not entitled to use PEACE BANNERS.ORG is she/he is required to declare herself/himself to authorities on the base of a sentence against her/him for sexual offense or other similar offenses.
The User undertakes to keep her/his personal Data up to date.
The User shall not communicate her/his password or allow anyone else to access her/his account and shall take all necessary measures to ensure her/his account’s security.
PEACE BANNERS may delete or modify any user name deemed inappropriate (e.g. when the owner of a trademark or a trade name claims that a user name does not correspond to the User’s real name).
PEACE BANNERS may delete Data posted on PEACE BANNERS.ORG without compensation of any kind if PEACE BANNERS estimates that the Data breaches its TAC, DPP or Ethical Charter.
If a User breaches the letter or spirit of the TAC or creates by other means a risk of claim or reputation against PEACE BANNERS, PEACE BANNERS may stop providing services to such a User, in whole or in part, without further notice or compensation of any kind.
The cancellation by any User of her/his is simple; it is done by the User her/himself throught its profile menu. The User accordingly waives any service or benefits pertaining to PEACE BANNERS, without any kind of compensation. All his data will be deleted instantly, we do not save any data.

5 DATA AND USER RESPONSIBILITY
PEACE BANNERS does its best to ensure that PEACE BANNERS.ORG is safe and secure; however, due to the current state of technology, PEACE BANNERS cannot alone ensure an absolute security. Therefore, PEACE BANNERS requires each User of PEACE BANNERS.ORG to contribute to the security of the website and its Data.
The User undertakes to only post Data which she/he is entitled to post and for which she/he is entitled to confer a free unlimited license to PEACE BANNERS.
The User undertakes not to post any undesirable messages (spams, discriminatory, hateful, racist, homophobic messages, etc.) on PEACE BANNERS.ORG.
The User undertakes not to post any threats, or any data that is menacing in any way or that calls for hate or violence, or of pornographic nature.
The User undertakes not to post commercial advertisements on PEACE BANNERS.ORG without prior authorization from PEACE BANNERS.
The User undertakes not to seek to obtain Data on other Users by any other mean than the lawful access to PEACE BANNERS.ORG, and not to access PEACE BANNERS.ORG by automated means (such as robots, spiders, etc.) without PEACE BANNERS’s prior consent.
The User undertakes not to carry out wild or illegal marketing (including multi-level marketing) on PEACE BANNERS.ORG.
The User undertakes not to download any virus or other hostile codes.
The User undertakes not to require login details from other Users, and not to access their account.
The User undertakes not to intimidate or harass other Users.
The User undertakes not to develop or run a third application containing or promoting content that is prohibited by the TAC, encouraging the consummation of alcoholic beverages or any illegal or reprehensible behavior.
The User undertakes not to include links forwarding to adult websites or to other contents reserved to adults (including advertisements) without an age restriction access (and with strict conformity to the TAC).
The User undertakes to comply with the applicable legislation as well as PEACE BANNERS’s internal rules and regulations, in particular if she/he wishes to organize a competition, lottery or free distribution of samples («Promotion») on PEACE BANNERS.ORG.
The User undertakes not to use PEACE BANNERS.ORG for any illegal, unlawful, malicious or discriminatory activity.
The User undertakes not to act in any way that could deactivate, overload or otherwise prevent the good functioning or appearance of PEACE BANNERS.ORG (such as an attack leading to a service denial or an interface displaying webpages or features of PEACE BANNERS.ORG).
The User undertakes not to use trademarks or protected content or specific PEACE BANNERS content (such as «PEACE BANNERS», PEACE BANNERS logo, etc. – see detailed list in «Trademarks, Logos and Lexicon») or any other confusing trademark, unless expressly allowed under PEACE BANNERS’s trademark usage rules or upon PEACE BANNERS’s prior authorization.
Should a User collect Data from other Users, she/he undertakes to obtain their consent, to clearly indicate that it is her/him in her/his capacity as a User (and not PEACE BANNERS) who is collecting this Data and to disclose her/his data privacy policy indicating the Data collected and the intended use thereof.
The User undertakes not to post official documents or financial information concerning other Users on PEACE BANNERS.ORG.
The User undertakes not to identify the people who are not using PEACE BANNERS.ORG and not to send them electronic messages from PEACE BANNERS.ORG without their consent.
The User undertakes not to allow or encourage the breach of the TAC, DPP or PEACE BANNERS’s Ethical Charter.
In the event of a claim against PEACE BANNERS following an action imputable to one or several specific User(s) or to their Data on PEACE BANNERS.ORG, the Users concerned shall compensate and hold harmless PEACE BANNERS for any loss, responsibility, query, request, expenses and fees, including lawyer’s fees, related to such a complaint.

6 ACTIONS AND SHARING OF ACTIONS
PEACE BANNERS encourages the User to act for the benefit of the human community at large. This well-wishing orientation is clearly indicated and defined in PEACE BANNERS’s Ethical Charter and is to be accepted and complied with by the User.
When undertaking an action, the User commits her/himself to a proper use of PEACE BANNERS.ORG. The User can share her/his actions with other Users on PEACE BANNERS.ORG and beyond. Any action undertaken by the User will allow her/him to obtain benefits, detailed under “PEACE BANNERS.ORG tutorial and guidelines”.
This approach requires sincerity and honesty from the User. The User who commits her/himself to undertake actions and to post them on PEACE BANNERS.ORG agrees to post and share only actions that she/he has truly undertaken and to do this in a serious and well-wishing manner.
Regardless of the supervision PEACE BANNERS may perform, PEACE BANNERS may delete the account of any User who breaches PEACE BANNERS’s Ethical Charter (which expressly requires honesty and sincerity as admission requirements to PEACE BANNERS.ORG) without further notice.
Caution! While PEACE BANNERS encourages its Users to undertake actions, Users are warned against the temptation to go off limits and put oneself, or other people, or even other living creatures in danger. PEACE BANNERS cannot be held liable in any way if a User puts her/himself or someone else’s life in danger on the pretext of accomplishing an action. PEACE BANNERS may in no event be held liable for any accident or incident, of any type, that may arise in such a context.

8 PROJECTS
On its platform, PEACE BANNERS offers its members the opportunity to present, in an environment specifically reserved for this purpose, personal or group projects (scientific, literary, artistic, solidarity, etc.) which they are resolved to materialize, and which, directly or indirectly, bear value for society in general and for the PEACE BANNERS community in particular.
Any submitted project is bound to raise the interest of one or more member(s) of PEACE BANNERS. This interest is typically expressed in the manner and terms shown and specified in the “operating instructions” (see footer) section.
The projects that are commended by the members of PEACE BANNERS are likely, in proportions and shapes at the discretion of PEACE BANNERS, to gain support, in the form of full or partial funding, or any other form deemed appropriate by PEACE BANNERS (that may involve sponsors and / or partners), which will give them a chance of completion and / or implementation.

9 PAYMENTS
9.1 FINANCIAL TRANSACTIONS
All financial transactions with PEACE BANNERS which are meant to pay subscription fees or other services offered by PEACE BANNERS are done on PEACE BANNERS.ORG according to the terms indicated in the sections offering the services on PEACE BANNERS.ORG. The User undertakes to respect PEACE BANNERS’s “General Terms of Payment”.

10 CONFLICTS AND GORVERNING LAW
Any conflict linked with the TAC or PEACE BANNERS shall be exclusively submitted to the courts of Geneva, Switzerland.
The TAC and any legal action between the Users and PEACE BANNERS are governed by the laws of Switzerland, except whenever the rules of conflicting laws apply.
Even though PEACE BANNERS sets the rules relating to Users’ behavior, PEACE BANNERS cannot supervise or act upon Users’ actions on PEACE BANNERS.ORG. PEACE BANNERS may by no means be held liable for the Data posted or shared by Users on PEACE BANNERS.ORG.
PEACE BANNERS is not liable for offending, inappropriate, obscene, illegal or otherwise shocking Data that could be seen by Users on PEACE BANNERS.ORG.

PEACE BANNERS TRIES TO PROVIDE ITS SERVICES KEEP WITHIN A BUG-FREE AND SAFE ENVIRONMENT. NEVERTHELESS, USERS USE PEACE BANNERS.ORG AT THEIR OWN RISK. PEACE BANNERS PROVIDES PEACE BANNERS.ORG AS IS WITHOUT ANY EXPRESS OR IMPLIED WARRANTIES (IN PARTICULAR WARRANTIES OF MERCHANTABILITY, OR FITNESS FOR A PARTICULAR PURPOSE). PEACE BANNERS DOES NOT GUARANTEE THAT PEACE BANNERS.ORG WILL ALWAYS BE SAFE, SECURE OR ERROR-FREE OR THAT PEACE BANNERS.ORG WILL ALWAYS FUNCTION WITHOUT DISRUPTIONS, DELAYS OR IMPERFECTIONS. PEACE BANNERS IS NOT LIABLE FOR THE ACTIONS, CONTENT, INFORMATION, OR DATA OF THIRD PARTIES, AND USERS RELEASE PEACE BANNERS, ITS DIRECTORS, BOARD MEMBERS, EMPLOYEES, AND AGENTS FROM ANY CLAIMS AND DAMAGES, KNOWN AND UNKNOWN, ARISING OUT OF OR IN ANY WAY CONNECTED WITH ANY CLAIM USERS HAVE AGAINST ANY SUCH THIRD PARTIES. IN ANY CASE, PEACE BANNERS’S LIABILITY WILL BE LIMITED TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW.
